Terms of Use

These terms explain the rules that apply when you access PicText or use our AI-powered tools to create, edit, and transform images.

These Terms of Use (“Terms”) form an agreement between you and PicText (“PicText,” “we,” “us,” or “our”) and govern your use of the PicText website, image-processing tools, and related services that link to these Terms (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and acceptance

You must be at least 13 years old to use PicText. If the law where you live requires a higher minimum age, that higher age applies. If you are not old enough to enter into a binding agreement, a parent or legal guardian must review and accept these Terms on your behalf.

You may use the Service only if doing so is lawful where you live and you are not prohibited from receiving the Service under applicable law.

2. The PicText Service

PicText provides tools that may use artificial intelligence and other processing technologies to create, edit, extract, replace, or transform visual content. Some tools may be available without an account. Features, usage limits, supported file types, and availability may change as the Service develops.

We may add, modify, suspend, or discontinue any part of the Service when reasonably necessary for maintenance, security, legal compliance, product improvement, or business operations.

3. Your content

“Input” means any image, text, instruction, or other material you submit to the Service. “Output” means content produced by the Service in response to your Input. You retain any rights you already hold in your Input.

You grant PicText and its service providers a limited, worldwide license to host, copy, transmit, modify, and process your Input and Output only as reasonably necessary to operate, secure, maintain, and improve the Service, comply with law, and enforce these Terms. This license ends when the relevant content is deleted from our systems, except where continued retention is required by law or for legitimate security and operational records.

You confirm that you have all rights, permissions, and consents needed to submit your Input and allow us to process it. You are responsible for your Input, your instructions, and how you use or distribute any Output.

4. AI-generated and edited output

Subject to applicable law and third-party rights, PicText does not claim ownership of Output solely because it was produced through the Service. Laws concerning AI-generated content differ by jurisdiction, and Output may not qualify for copyright or other protection.

AI and automated editing tools can produce inaccurate, unexpected, incomplete, or similar results for different users. We do not guarantee that Output is unique, accurate, non-infringing, or suitable for a particular purpose. You must review Output before relying on it, publishing it, or using it commercially.

5. Acceptable use

You may not use the Service to:

  • break the law, facilitate wrongdoing, or violate the rights of another person;
  • upload or create content that infringes intellectual property, privacy, publicity, or other rights;
  • create deceptive impersonations, non-consensual intimate imagery, or manipulated media intended to defraud or seriously harm others;
  • exploit or endanger children, promote hatred or violence against protected groups, or threaten physical harm;
  • distribute malware, probe vulnerabilities, disrupt the Service, bypass safeguards, or gain unauthorized access;
  • use bots, scraping tools, or automated requests in a way that overloads the Service or circumvents stated limits; or
  • misrepresent Output as human-created when disclosure is required by law or necessary to avoid deception.

We may block a request, remove content within our control, restrict access, or take other reasonable action when we believe use of the Service violates these Terms, creates risk, or is required by law.

6. PicText property

The Service, including its software, interface, design, text, logos, and other materials provided by PicText, is owned by PicText or its licensors and is protected by intellectual-property laws. These Terms give you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for its intended purpose.

You may not copy, sell, sublicense, reverse engineer, modify, distribute, or create derivative works from the Service itself except where applicable law expressly permits it or we give prior written permission.

7. Third-party services and links

PicText relies on third-party infrastructure and processing providers, and the Service may include links to websites we do not control. Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party websites, content, availability, or practices.

8. Availability and changes

The Service may occasionally be unavailable, delayed, limited, or affected by technical issues outside our control. We do not promise that every feature will always be available, that processing will always succeed, or that files and Output will remain available. Keep your own copies of important material.

9. Suspension and termination

You may stop using PicText at any time. We may suspend or restrict access to the Service if we reasonably believe you violated these Terms, created legal or security risk, abused shared resources, or if suspension is needed to comply with law. Provisions that by their nature should continue—such as ownership, disclaimers, liability limitations, and dispute terms—survive termination.

10. Disclaimers

To the fullest extent permitted by law, the Service and all Output are provided “as is” and “as available.” PicText disclaims all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation.

PicText does not provide legal, medical, financial, or other professional advice. Output should not be used as a substitute for qualified professional judgment.

11. Limitation of liability

To the fullest extent permitted by law, PicText and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, business opportunities, or service availability arising from or related to your use of the Service.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the extent permitted by law, and nothing in these Terms limits rights that cannot legally be waived.

12. Your responsibility to PicText

To the extent permitted by law, you agree to defend, indemnify, and hold harmless PicText and its service providers from third-party claims, losses, and reasonable costs arising from your Input, your use of Output, your violation of these Terms, or your infringement of another person’s rights.

13. Changes to these Terms

We may update these Terms when the Service, our practices, or applicable law changes. We will post the revised version on this page and update the “Last updated” date. Your continued use of the Service after revised Terms take effect means you accept them.

14. General terms

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent; we may transfer these Terms as part of a reorganization, financing, merger, acquisition, or sale of assets.

These Terms and the Privacy Policy are the entire agreement between you and PicText concerning the Service, except where separate written terms expressly apply. Applicable law determines any rights and remedies that cannot be modified by contract.
